1. Introduction

Welcome to PropHedge ("we", "our", "us"). These Terms and Conditions ("Terms") govern your access to and use of the website www.prophedge.net (the "Site") and the related services provided by PropHedge. By registering for and/or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. Description of Services

PropHedge provides a subscription-based service that includes:

• Access to a Personalized Dashboard:
  Registered users can log in to a secure dashboard, where they can monitor and analyze their trading data.
• Downloadable Expert Advisor for MetaTrader 5:
  Users can download an Expert Advisor (EA) that connects to our database to receive data and execute trades on the MetaTrader 5 platform. The EA is designed to manage trading by placing orders and executing edging strategies between two accounts.
• Data Analysis and Reporting:
  Through the dashboard, users can review analyses of their trading challenges, funded accounts, split calculations, performance metrics (e.g., break-even status, profit predictions), and more.
• Subscription Plans:
  The service is available on a paid basis with two subscription options: a monthly subscription and a lifetime subscription (one-time payment).

3. Registration and Account

• Registration Process:
  To use our service, you must register an account. Registration can be completed either by using your email address or through Google authentication. In both cases, the only personal data required is your email address (and, in the case of Google authentication, the information provided by your Google account).
• Account Security:
  You are responsible for maintaining the confidentiality of your account credentials. We implement standard security measures (such as encryption, firewalls, and restricted access controls) to protect your information, but you must also take appropriate steps to ensure the security of your account.

4. License and Restrictions on Use

• License Grant:
  Upon successful registration and subscription, you are granted a non-exclusive, non-transferable, limited license to use the Expert Advisor and access the PropHedge dashboard in accordance with these Terms.
• Prohibited Conduct:
  • License Sharing and Account Sharing: Sharing your license or account credentials with third parties is strictly prohibited.
  • Resale of the Service or Software: Reselling or otherwise distributing the Expert Advisor or access to the PropHedge service is not permitted.
  • Unauthorized Use: Any use of our service or software that is not expressly permitted in these Terms is prohibited.

5. Payment and Subscription

• Subscription Options:
  PropHedge offers two subscription plans:
  • Monthly Subscription: Recurring payments for continued access.
  • Lifetime Subscription: A one-time payment for permanent access.
• Payment Terms:
  Payments must be made in accordance with the pricing and payment methods displayed on the Site. All fees are non-refundable unless otherwise stated.
• Changes to Pricing:
  We reserve the right to change our subscription fees or payment methods at any time. In such cases, we will notify you of changes in advance, where possible.

6. Intellectual Property

• Ownership:
  All content, software (including the Expert Advisor), data, graphics, and any other materials available on the Site are the property of PropHedge or its licensors and are protected by intellectual property laws.
• User Restrictions:
  You are not permitted to reproduce, distribute, modify, or create derivative works of any materials provided through the service, except as expressly authorized by PropHedge.

7. Disclaimer of Warranties

• Service "As Is":
  The PropHedge service and the Expert Advisor are provided on an "as is" and "as available" basis without any warranties of any kind, either expressed or implied.
• No Guarantee of Results:
  PropHedge does not guarantee the accuracy, reliability, or performance of the Expert Advisor or the dashboard analytics. Users are advised to adhere to the provided documentation and use the service responsibly.
• Limitation on Use:
  You acknowledge that the use of the Expert Advisor and other services is at your own risk. PropHedge disclaims any liability for losses or damages arising from errors, interruptions, or malfunctions in the service.

8. Limitation of Liability

To the fullest extent permitted by applicable law, PropHedge shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of or inability to use the service, including but not limited to any errors or interruptions in the operation of the Expert Advisor.

9. Modifications to the Terms

PropHedge reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Significant modifications may be communicated via email or through a notice on the Site. Your continued use of the service following any modifications constitutes acceptance of the updated Terms.

10. Termination and Suspension

• User Termination:
  You may cancel your monthly subscription at any time. Upon cancellation, your access to the service will terminate at the end of the current billing period.
• Service Termination:
  PropHedge reserves the right to suspend or terminate your account and access to the service if you violate these Terms.
• Business Decisions:
  In the event that PropHedge ceases operations or discontinues the service, we reserve the right to terminate accounts and discontinue access, with reasonable notice provided where possible.

11. Privacy and Data Protection

Your personal data is handled in accordance with our Privacy Policy, which is incorporated by reference into these Terms. Please review the Privacy Policy for detailed information on how we collect, use, and safeguard your data.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Italy. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Milan, Italy.
